Overview

This policy is designed to protect the best interests of R3Host customers as a whole. We reserve the right to suspend or cancel a customer's access to any or all services provided by us if it is deemed that the account has been inappropriately used. All services are intended for the end user only and may not be subleased, sold or given to third parties for any reason.

Content Restrictions

Your R3Host account may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States federal, state, or local law is strictly prohibited. This includes but is not limited to copyrighted or trademarked material and material protected by trade secret.

Pornography, nudity, sex-related merchandising, IRC related material, wares related material, and any links to any such content are strictly prohibited on R3Host servers.

You are solely responsible for the content stored on and served by your R3Host account.

R3Host reserves the right to remove any material from a client's web space that is deemed unacceptable by us.

If your account is found to be in violation of this policy, R3Host reserves the right to disable or terminate the offending account without refund or prior notification.

Is the customer responsibilities to backup their own account, all resellers and shared customers will have to backup their site on their own, we are not responsible for any of your customer or your own web site backup.

Resource Restrictions

No site may use more than 10% of the total server output at any given time.

Chat room software tends to use a lot of system resources, and therefore is prohibited from R3Host servers. This does not include forum software or chat room software that may be automatically installed from your R3Host control panel.

Unsolicited Email/Spam

R3Host takes a zero-tolerance policy regarding the transmission of unsolicited commercial email (referred to as SPAM) from our servers. This includes SPAM that advertises any website located on a R3Host server or uses a return address residing on a R3Host server. Upon notification of a violation of this policy, R3Host will investigate the complaint within 24 hours. If the complaint is found to be valid, R3Host reserves the right to cancel the offending account immediately without notice and without any type of refund. R3Host also reserves the right to charge an administrative fee of $70.00 per SPAM message, not to exceed $300.00 per account. Unsolicited commercial postings to newsgroups are consider SPAM under this policy.

Server Abuse/Network Security

Violations of system or network security are prohibited, and may result in criminal and civil liability. R3Host will investigate incidents involving such violations and may involve and will cooperate with law enforcement if a criminal violation is suspected.

Examples of system or network security violations include, but are not limited to, the following:

1) Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network.

2) Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network.

3) Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks.

4) Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

5) Use of R3Host's service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm, destruction of property, or could be construed as libel.

Payments and Fees

R3Host uses Paypal as a method of payment. R3Host will send a bill to the customer and he/she is responsable of paying the fees on time. Your are responsable to monitor your bandwidth usage. R3Host will charge any bandwidth overages for the prior month. Cost per GB of Bandwidth overages is $2.00.

If a clients payment is declined for any reason, the client will be notified by email. The client will have 5 days to pay the fee or his/her account will be deactivated. There will be a $5.00 activation fee assessed to all accounts that have been deactivated because the payment failed to be sent after the 5th day. If the account is deactivated for more than 10 days, the account will be deleted from the server and the client will need to sign up for a new account, and R3Host is NOT responsable for the backup of your old account.

Refunds

R3Host offers a 7 day money back guarantee. If at anytime during your first 7 days as a client of R3Host, you are unsatisfied with our service, you may get a full refund. This offer is only valid in the first 7 days as a R3Host customer. If you are found to be in violation of this agreement or our Acceptable Use Policy, you are not entitled to take advantage of the 7 day money back guarantee. Please submit a trouble ticket if you would like to request a refund. After your initial 7 days, all payments to R3Host are non-refundable. If you dispute a charge to your credit card issuer that, in R3Host's sole discretion is a valid charge under the provisions of this agreement (Terms of Service) or our Acceptable Use Policy, you agree to pay R3Host an administrative fee of $20.00. Refund is only valid for Shared Hosting Packages.

Disclaimer

R3Host will not be held responsible for any damages you or your business may suffer while using our service. R3Host makes no warranties of any kind, expressed or implied, for services rendered. R3Host disclaims any warranty or merchantability or fitness for a particular purpose. R3Host assumes no liability for disruptions or improper operation of its equipment or software for any reason, including, but not limited to, vandalism, theft, phone service outages, Internet disruptions, human error, extreme or severe weather conditions or any other causes in the nature of "Acts of God" or force of nature. R3Host will NOT be responsible for consequential damages or punitive or exemplary damages under any circumstances. In no case will the client be entitled to recover damages from R3Host.

Term

The term of this agreement will continue until a notice of cancellation by R3Host or the client is given, or until terminated under other provisions of this Agreement. R3Host reserves the right to terminate this agreement without cause upon notification to the client. R3Host may further terminate this agreement immediately with notice at any time the client breaches any part of this agreement, or if any program or facility used by R3Host to implement this agreement is disrupted or terminated for any reason.
